1. Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of Curling Stats (the “Service”), including the website available at https://curlingstatistics.com and any related services.
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.
2. Description of the Service
Curling Stats is a web application that allows users to record and analyze curling game data, including but not limited to:
- Teams and rosters
- Curlers and positions
- Games, ends, and scores
- Shot-by-shot statistics and notes
- Seasons, events, and related analytics
- Optional coaching and “Virtual Coach” features
The specific features available to you may change over time as we improve and update the Service.
3. Eligibility and Account Registration
To use the Service, you must:
- Be at least 13 years old (or the age of digital consent in your jurisdiction, if higher)
- Have the legal capacity to enter into a binding agreement
Account creation and authentication are provided by Clerk. You may sign in using email/password or third-party identity providers such as Google.
You are responsible for:
- Maintaining the confidentiality of your login credentials
- Restricting access to your account and devices
- All activities that occur under your account
If you believe your account has been compromised, you must notify us promptly.
4. User Content and Data Ownership
You retain ownership of the content and data you submit to the Service (“User Content”), including:
- Team names, rosters, and curler information
- Games, scores, shot data, and notes
- Seasons, statistics, and coaching-related data
By submitting User Content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, process, and display that content as necessary to operate and improve the Service.
You are responsible for ensuring that:
- You have the necessary rights to submit the User Content
- Your User Content does not violate any third-party rights (including privacy, publicity, or intellectual property rights)
5. Public Sharing Features
The Service may provide features that allow you to make certain data publicly accessible, such as:
- Public team pages and statistics accessible via shareable links (e.g.,
/t/[slug])
When you enable public sharing for a team or other entity:
- The associated data may be visible to anyone with the link
- We may apply technical measures (such as rate limiting and “noindex” directives), but we cannot fully control third parties’ use of publicly visible information
You can disable public sharing for a team to stop serving that data going forward. However, this does not remove content already copied or stored by others.
6. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Infringe the rights of others, including privacy, publicity, or intellectual property rights
- Harass, abuse, or harm others
- Upload or share content that is unlawful, defamatory, obscene, hateful, or otherwise objectionable
- Attempt to gain unauthorized access to the Service, other users’ accounts, or related systems or networks
- Interfere with or disrupt the integrity or performance of the Service
- Circumvent or attempt to circumvent security or rate-limiting controls
We reserve the right (but have no obligation) to review, remove, or disable access to User Content that, in our reasonable judgment, violates these Terms or poses a risk to the Service or its users.
7. Third-Party Services
The Service relies on third-party providers to function, including:
- Clerk for authentication and user management
- Supabase for database hosting and storage
- OpenAI for optional AI coaching features
- Cloud hosting providers (e.g., Vercel) for application hosting
Your use of these third-party services may be subject to their own terms and privacy policies. We are not responsible for the content, policies, or practices of third-party services.
8. AI and Coaching Features
If you enable coaching or “Virtual Coach” features, certain User Content (such as game notes, coaching questions, and contextual information about your teams and games) may be processed by third-party AI providers to:
- Generate text-based coaching responses and assessments
- Provide drill suggestions or related insights
- Perform semantic search over your notes and historical data
AI-generated content is inherently probabilistic and may be incomplete, incorrect, or inappropriate. You should not rely on AI-generated content as professional advice.
You remain responsible for how you use any information or recommendations generated by these features.
9. Intellectual Property
All rights, title, and interest in and to the Service (excluding User Content) are and will remain the exclusive property of the Service operator and its licensors. This includes:
- Software, code, and application logic
- Visual design and user interface elements
- Logos, trademarks, and branding
- Documentation and other related materials
Nothing in these Terms grants you any right to use our trademarks, logos, or other brand features without our prior written consent.
10. Feedback
If you provide feedback, suggestions, or ideas about the Service (“Feedback”), you understand that:
- We may use the Feedback without obligation to you
- You grant us a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, and incorporate the Feedback into the Service or other products
11. Service Changes and Availability
We may modify, update, or discontinue parts of the Service at any time, including by:
- Adding or removing features
- Changing data models or interfaces
- Performing maintenance or upgrades
We aim to provide a reliable Service, but we do not guarantee uninterrupted or error-free operation. We are not liable for any loss or damage resulting from interruptions, delays, or changes to the Service.
12. Termination
You may stop using the Service at any time.
We may suspend or terminate your access to the Service, with or without notice, if:
- You materially violate these Terms
- You misuse the Service or interfere with its normal operation
- We are required to do so by law or a third-party provider
Upon termination:
- Your right to access and use the Service will cease
- We may retain certain data as described in our Privacy Policy and as required by law
13. Disclaimers
The Service is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express or implied, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
- Any warranties arising from course of dealing or usage of trade
We do not warrant that:
- The Service will be uninterrupted, secure, or free of errors
- Any data or content (including AI-generated content) will be accurate, complete, or reliable
You use the Service at your own risk.
14. Limitation of Liability
To the maximum extent permitted by applicable law, in no event will we be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of profits, revenue, data, or goodwill
- Any damages arising out of or in connection with:
- Your access to or use of (or inability to access or use) the Service
- Any conduct or content of other users or third parties
- Any content obtained from the Service (including AI-generated content)
Our total liability for any claim arising out of or relating to the Service will not exceed the amount you have paid us (if any) for the Service in the twelve (12) months immediately preceding the event giving rise to the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages or implied warranties, so some of the above exclusions or limitations may not apply to you.
15. Indemnification
You agree to indemnify and hold harmless the Service operator and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in connection with:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another person or entity
16. Governing Law
These Terms and any dispute arising out of or relating to them or the Service will be governed by and construed in accordance with the laws of the jurisdiction in which the Service operator is organized, without regard to its conflict of law provisions.
You agree to submit to the personal and exclusive jurisdiction of the courts located in that jurisdiction to resolve any legal matter arising from these Terms or the Service.
17. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page.
If changes are material, we may also provide additional notice (for example, by displaying a notice in the app).
Your continued use of the Service after the updated Terms become effective will constitute your acceptance of the revised Terms.
